General Guidelines
– I will wear an approved helmet, eye protection and appropriate protective clothing
– I will not drink alcohol or use drugs before or during the ride
– I understand and respect the performance and operational characteristics of the vehicle
– I have read and will follow the safety labels and the safety messages in the cluster

Can-Am 3-Wheel – Are you a Driver or a Passenger?

3WV-Passenger 1

I must be able to reach the passenger footpegs and handholds or seat strap. If I can not reach, I will tell the driver and get off

3WV-Passenger 2

I will always be prepared for a sudden stop, bumps or change of direction in case of emergencies

3WV-Driver 1

This vehicle is not a motorcycle. It is wider than a motorcycle

3WV-Driver 2

I have the proper driving license to drive the three-wheel vehicle

3WV-Driver 3

I must use the right-foot pedal to brake all three wheels

I will always steer directly in the direction of the turn. I will not countersteer to initiate a turn

I will always operate at a safe speed and keep a safe distance from others considering the traffic, road conditions, visibility conditions and my experience. I will always be prepared to stop or change directions in case of emergencies

If I bring a passenger:
– I will tell the passenger to always hold handholds and keep feet on pegs. I will also inform them to watch the road, lean into curves and brace for bumps
– I have read the section applicable to passengers and understand I am responsible for my passengers
– I made sure my passenger has read, understood and signed the Waiver

2WEV-Passenger 1

– I will Instruct the passenger to always hold on and keep feet on pegs, to watch the road, brace for bumps
– I have read the section applicable to passengers and understand I am responsible for my passenger
– I made sure my passenger has read, understood and signed the Waiver

READ CAREFULLY. YOU ARE GIVING UP RIGHTS AND ACKNOWLEDGING TO RISKS.

I am of legal age where this Waiver and Release of Liability (Waiver) is signed (or I am the parent or legal guardian of a minor and am signing this Waiver for this minor).

WARNING: RISKS OF PARTICIPATION:

THE ACTIVITIES PRESENT RISKS. RIDE IN ACCORDANCE WITH YOUR ABILITIES.
Examples of risks include:
● Serious physical injury
● Death
● Tipping/rolling over
● Crashing/collision
● Ejection

ASSUMPTION OF RISK:

I UNDERSTAND THE RISKS OF PARTICIPATING IN THE ACTIVITIES.
My Responsibilities:
When I use the Product or participate in the Activities, I will:
● Ride within my abilities and capacities. This also means I don’t have a health condition that could worsen if I ride or put myself or others in danger
● Verify the Product to make sure it is working properly and notify the responsible person if it is not
● Respect all applicable laws, rules and regulations
● Comply with directions and/or instructions given
● Respect the safety checklist attached below
● Familiarize myself with the Product before I start riding
● Not be under the influence of drugs, alcohol or anything that could impair my judgment and faculties
● Be responsible for any damage that I cause to the Product or someone else’s property
● Be responsible for any injury I cause to myself or someone else
● Be responsible for any fine, penalty or ticket I may get if I do not follow the rules
● Drive safely and with caution

If I Bring a Passenger:
If I bring anyone with me, I will be responsible for:
● My passenger(s)
● Anyone I allow to use the Product

WAIVER AND RELEASE OF LIABILITY:

IF I SUFFER ANY INJURIES OR LOSS AS A RESULT OF THE ACTIVITIES, I WAIVE MY RIGHTS TO MAKE LEGAL CLAIMS AGAINST THE FOLLOWING “RELEASED PARTIES”:
● Bombardier Recreational Products Inc., its affiliates and subsidiaries (BRP)
● Any BRP dealers, distributors and rental operators
● BRP contractors and service providers
● The organiser of the event where the Activities take place
● The employees and consultants of the parties listed above
● The insurers of the parties listed above

This release also binds my representatives and anyone who may represent me to make a claim.

Indemnification:
If my conduct or my actions during the Activities cause:
● Injuries/death to me
● Injuries/death to others
● Damages
I will indemnify and hold the Released Parties harmless.

Validity:
If any part of this Waiver is determined to be invalid by law, all other parts of this Waiver will remain valid and enforceable.

Picture Consent:
I authorize BRP and the organizer of the Activities to take pictures and videos and to publish them on their websites and social media. I can remove my consent at anytime by writing to privacyofficer@brp.com.

Emergency:
I authorize BRP and the organizer of the Activities’ staff to get emergency medical treatment for me during the Activities and to contact my emergency contact. I will be responsible for the costs associated with the evacuation and treatment.

I Read This Waiver:
I had time to properly read this Waiver and the attached checklist(s) and understand them. I was able to ask my questions if I had any.

Commercial communications

I wish to receive commercial communications from Bombardier Recreational Products Inc., its affiliates and subsidiaries, its dealer and distributor network and select third parties (“BRP”) via email, text message, post, telephone, telemarketing or other means of communication.

Data collect

I allow BRP to collect and use the information I provided for customized marketing purposes. I understand that data analytics profiling is used to enhance my experience, and the overall BRP experience to reach others who have similar interests.
